Turd TrackerEffective Date: December 3, 2025Welcome to Turd Tracker. These Terms of Service ("Terms") govern your use of the Turd Tracker mobile application ("the App"), operated by Trail Hacker LLC, a California limited liability company ("we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.If you do not agree to these Terms, do not use the App.1. License to UseWe grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, subject to these Terms. This license does not include the right to modify, distribute, sell, or create derivative works based on the App.2. App DescriptionTurd Tracker is a trail cleanup tool that uses location-based technology to help users mark and retrieve dog waste bags. The App uses geofenced reminders to notify users when they are near a previously marked location.3. User ResponsibilitiesBy using the App, you agree to:- Use the App only for its intended purpose of marking and retrieving waste bags
- Comply with all applicable local, state, and federal laws
- Follow all posted rules and regulations of trails, parks, and public lands you visit
- Not use the App while operating a vehicle or in any manner that endangers yourself or others
- Take responsibility for the proper disposal of waste in accordance with local regulations4. Location ServicesThe App requires access to your device's location services, including background location, to function. You are responsible for ensuring that location permissions are properly configured on your device. GPS accuracy may vary depending on environmental conditions, device capabilities, and other factors beyond our control.5. Disclaimer of WarrantiesTHE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy or reliability of location data, geofencing functionality, or notification delivery.To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.6. Limitation of LiabilityTO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the App, even if we have been advised of the possibility of such damages.We are not responsible for any damages or liability arising from: missed notifications or reminders; inaccurate location data; failure to retrieve marked items; environmental conditions on trails; or any injuries, accidents, or property damage that may occur while using the App.In no event shall our total liability exceed the amount you paid for the App (which is zero, as the App is provided free of charge).7. IndemnificationYou agree to indemnify, defend, and hold harmless Turd Tracker and its developers, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the App or violation of these Terms.8. Intellectual PropertyThe App and all content, features, and functionality (including but not limited to design, graphics, text, and software) are owned by Turd Tracker and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.9. TerminationWe reserve the right to terminate or suspend your access to the App at any time, without notice, for any reason, including if we believe you have violated these Terms. You may terminate your use of the App at any time by uninstalling it from your device.10. Changes to These TermsWe may update these Terms from time to time. Any changes will be posted within the App or on our website with an updated effective date. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.11. Governing LawThese Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in California.12. SeverabilityIf any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.13. Entire AgreementThese Terms, together with our Privacy Policy, constitute the entire agreement between you and Turd Tracker regarding the use of the App and supersede any prior agreements.14.
